1. Scope

The following General Terms and Conditions apply to all orders placed through our online store. Our online shop is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity. A business is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the course of its commercial or independent professional activity.

2. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with Leopold’s - FINEST FOR DOGS GmbH.

By listing the products in the online shop, we are making a binding offer to conclude a contract for these items. You may initially add our products to your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the ordering process.

By submitting an order via the Leopold’s Finest Online Shop by clicking the “Order” button, the customer places a legally binding order. The customer is bound by the order for a period of two (2) weeks after placing the order. The customer’s right to cancel the order, if applicable under Section 12, remains unaffected by this.

Leopold’s Finest will immediately confirm receipt of the order placed via the Leopold’s Finest Online Shop to the customer by email. Such an email does not constitute a binding acceptance of the order unless it contains both the confirmation of receipt and a declaration of acceptance. A contract is only concluded when Leopold's Finest accepts the customer's order by means of a declaration of acceptance or by delivering the ordered items.

If delivery of the goods ordered by the customer is not possible, for example because the relevant goods are out of stock, Leopold’s Finest will refrain from issuing a declaration of acceptance. In this case, a contract is not concluded. Leopold’s Finest will inform the customer of this immediately and will promptly refund any payments already received or offer a reasonable alternative to the customer.

For deliveries to Switzerland, the purchase contract is concluded between the buyer and MeinEinkauf AG, St. Gallen (CHE-331.561.017 VAT). This company also handles customs clearance, invoicing, and delivery within Switzerland. This service is included in the purchase price and any shipping costs charged. To ensure smooth delivery to Switzerland, we inform you for the sake of transparency that MeinEinkauf GmbH in Konstanz, Germany (DE285677365) is also integrated into the supply chain. This does not result in any additional costs for the buyer.

4. Delivery Terms

All prices listed in the Leopold's Finest Online Shop are gross prices including statutory sales tax (German sales tax) and do not include applicable shipping costs.

Shipping costs are listed alongside the prices in the Leopold's Finest Online Shop. The total price, including sales tax and applicable shipping costs, is also displayed in the order form before the customer submits the order.

Leopold's Finest is entitled to make partial deliveries, provided this is reasonable for the customer.

For orders from customers residing or having their place of business abroad, or in cases where there are reasonable grounds to suspect a risk of non-payment, Leopold's Finest reserves the right to deliver only after receiving the purchase price plus shipping costs (prepayment requirement). If Leopold's Finest exercises this right to require prepayment, the customer will be notified immediately.

We deliver only via shipping. Unfortunately, pickup of the goods is not possible.

We do not deliver to parcel stations.

Undeliverable or refused shipments: If a package is returned to us due to refusal of acceptance, an incomplete or incorrect address, or failure by the customer to pick it up, we reserve the right to pass on the full amount of the resulting shipping and return costs to the customer.

5. Payment

The following payment methods are generally available in our shop:

Credit Card

You will enter your credit card details during the ordering process. Your card will be charged after the goods have been shipped.

PayPal

To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate yourself with your login credentials, and confirm the payment instruction. The payment transaction is processed by PayPal immediately after the order is placed. You will receive further instructions during the ordering process.

PayPal may offer additional payment options in the customer account to registered PayPal customers selected according to its own criteria. However, we have no influence over the offering of these options; any additional payment options offered on an individual basis pertain to your legal relationship with PayPal. You can find further information on this in your PayPal account.

Sofort by Klarna

To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have a bank account enabled for online banking, authenticate yourself accordingly, and confirm the payment instruction. Your account will be debited immediately after the order is placed. Further instructions will be provided during the ordering process.

Gift Cards

Gift cards can be redeemed during the ordering process. The respective gift card amount is automatically applied to the highest-priced item in the order. If this item is returned, the redeemed gift card value will be credited accordingly. A cash refund of the gift card amount is excluded; any additional amounts paid will be refunded via the originally selected payment method.

6. Retention of Title

The goods remain the property of Leopold's Finest until full payment has been made.

7. Customer Account and Prohibition of Abuse


You have the option to create a customer account. Your login credentials must be treated as confidential and may not be disclosed to third parties.

Only one customer account is permitted per customer. Multiple registrations by the same person—particularly for the repeated use of discounts, vouchers, or special promotions—are prohibited.

In the event of violations, we reserve the right to block the affected customer accounts and cancel any orders.

8. Shipping Damage

If goods are delivered with obvious transport damage, please report such defects to the delivery carrier as soon as possible and contact us immediately. Failure to file a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance company.

9. Warranty and Guarantees

9.1 Liability for Defects

The statutory liability for defects applies.

9.2 Guarantees and Customer Service

Information regarding any applicable additional guarantees and their exact terms can be found with each product and on specific information pages in the online store.

10. Liability

Leopold’s Finest is liable to the customer in all cases of contractual and non-contractual liability for intentional acts and gross negligence in accordance with statutory provisions for damages or reimbursement of futile expenses.

In other cases, Leopold’s Finest is liable—unless otherwise provided in Section 3 below—only for a breach of a contractual obligation whose fulfillment is essential for the proper performance of the contract and on whose compliance the customer may reasonably rely (so-called cardinal obligation), and such liability is limited to compensation for foreseeable and typical damages. In all other cases, Leopold's Finest's liability is excluded, subject to the provision in Section 3 below.

Leopold's Finest's liability for damages resulting from injury to life, limb, or health and under the Product Liability Act remains unaffected by the above limitations and exclusions of liability.

11. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal. Details can be found in our Withdrawal Policy and during the ordering process.

12. Data Protection

Information regarding the processing of personal data can be found in our Privacy Policy, which forms an integral part of these Terms and Conditions.

13. Copyrights

All content on this website, in particular text, images, graphics, logos, videos, and design, is protected by copyright and other applicable laws.

It may not be copied, modified, distributed, or otherwise used without our express written consent.

The use of our content for your own commercial purposes is expressly prohibited.

14. Set-off, Right of Retention

The customer is not entitled to set off claims against Leopold’s Finest unless the customer’s counterclaims have been legally established or are undisputed. The customer is also entitled to set off claims against Leopold’s Finest if they assert complaints regarding defects or counterclaims arising from the same purchase contract.

As a buyer, a customer may exercise a right of retention only if their counterclaim arises from the same purchase contract.

15. Changes to the Terms and Conditions

We reserve the right to amend these Terms and Conditions at any time with future effect. We will inform you of any material changes in a timely manner. The current version is available at any time in our online shop.

16. Governing Law, Place of Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer placed the order as a consumer and has their habitual residence in another country at the time of the order, the application of mandatory legal provisions of that country remains unaffected by the choice of law made in the first sentence.

The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are willing to participate in an out-of-court conciliation procedure before a consumer conciliation body.

The competent authority is the Federal Universal Conciliation Body at the Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de.
